Don't call it a comeback. Or a sex tape.


When you’ve got your wife Rebecca Gayheart naked and going lesbo with a former Miss Teen USA, you’re a famous TV star, and you’ve got the only meat on the buffet table, it’s time to get out the video camera, because you have arrived.

This same thought occurred to Grey’s Anatomy star Eric Dane when he hooked up a threesome with Gayheart and Kari Ann Peniche, who was stripped of her Miss Teen USA title when she stripped herself for Playboy.

But don’t call it a sex tape, because Dane’s legal team will have you in court faster than you can say, “couple seeks attractive female.”

The tape shows Gayheart and Peniche topless in the hot tub, Gayheart and Peniche smoking cigarettes, and, unfortunately, the part of Dane's Anatomy that hangs between his legs.

The couple’s lawyer had this to say:

“This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public.

That much, at least, is true. Celebrities generally don’t mail their sex tapes to Bob Guccione and Larry Flyntbefore their hit medical drama goes off the air.

He goes on:

"Although the participants are nude, the tape is not a 'sex tape.' It is a private tape made for only my clients' personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability.”

For those unfamiliar with the language of the law, here is a glossary of fancy terms:

Consensual” means “tequila-induced,” “private” means “killer,” “personal” means “daily,” “nobody” means “the highest bidder or anyone with an Internet hook-up,” and “liability” means “tumescence.”
